FAILURE TO DIAGNOSE COLON CANCER/WRONGFUL DEATH
Doctors are trained to recognize signs and symptoms of illnesses of diseases. However, when a doctor fails to timely diagnose a disease, the result can be life altering for a patient.
It is well documented that early detection of colon cancer is crucial to a patient’s outcome. A colonoscopy is a screening tool that is commonly recommended for anyone over age 50. Symptoms of colon cancer include rectal bleeding/bloody stools; weakness or fatigue; change in bowel habits; unexplained weight loss. If timely diagnosed, treatment for colon cancer may include removal of polyps and/or surgery.
Summary of a Claim The family doctor of our client, a man in his mid-50s, obtained lab results of a blood sample which showed him to be anemic. However, the doctor failed to inform him of the lab results and further failed to render appropriate follow-up care, including obtaining additional diagnostic tests and referring the patient for a colonoscopy. Our client continued to treat with the doctor during numerous office visits over the next 20 months during which time he exhibited additional symptoms that are associated with colon cancer, including weight loss and bloody stools. Our client was finally diagnosed with advanced colon cancer, which was found to be terminal. Case settled with the doctor and the Indiana Patient Compensation Fund on behalf of the client's family for a significant amount.
