COMPARTMENT SYNDROME AND NERVE DAMAGE
Compartment Syndrome is a serious condition that involves increased pressure in a muscle compartment. It can lead to muscle and nerve damage and problems with blood flow. Swelling that leads to compartment syndrome typically occurs from trauma such as a car accident, crush injury, or surgery. Swelling can also be caused by complex fractures or soft tissue injuries due to trauma. Compartment Syndrome is most common in the lower leg and forearm, although it can also occur in the hand, foot, thigh and upper arm. If the pressure lasts long enough, muscles may die and the affected limb may not work anymore and may need to be amputated.
Summary of a Claim Our client was injured by another customer in a fight on the sidewalk in front of a bar as he and his friends were trying to leave. There had been fighting inside of the bar only minutes before involving the client’s girlfriend and an off-duty female bartender. The bar’s security video showed the bartender running from the bar out the front door with several persons trailing her, including the client’s attacker, in pursuant of the client’s group. The bar owner argued that the bartender was acting outside the scope of her employment. The attacker and his friends maintained that the client had ambushed him as he exited the bar. Our client sustained multiple fractures of his leg below the knee as he and the attacker fell to the sidewalk. He refused medical attention at the scene and did not go to the hospital until 8 hours later, by which time he had developed compartment syndrome to his leg. After multiple surgeries, the client was left with permanent nerve damage and a dropped foot. After a one-week trial in Randolph County, the jury returned a significant verdict for our client.
