Doctors can develop a certain level of expertise by performing tasks repeatedly. However, there is nothing routine about surgery.
It is common for surgeons to use small amounts of local anesthetics in and around surgical incision sites to numb that area before and during a procedure. Obviously, it is important for surgeons to be well-informed of the risks associated with using an excessive amount of these drugs.
In the past 15-20 years, a medical device known as a pain pump has been developed to infuse a continuous amount of local anesthetic in or around the patient’s incision site after the operation has been completed. The volume and manner of infusion of local anesthetics through these devices has been shown to have serious risks of injury in various types of procedures, especially in confined spaces such as the foot. Swelling, blistering, and even tissue necrosis (death) have been known to occur. In shoulder surgeries, destruction of the cartilage in the joint space has been associated with pain pumps.
Summary of a Claim In the course of reconstructive surgery on our 29-year old client’s left foot, the podiatrist surgeon inserted two pain pumps. The amount of local anesthetic infused into the client's foot greatly exceeded the drug manufacturer’s maximum recommended daily dosage. The client developed tissue necrosis, compartment syndrome, and necrotizing fasciitis in his foot and leg. Ultimately, he underwent a below the knee amputation. Case settled with the podiatrist and the Indiana Patient Compensation Fund for a significant amount.
