Falls involving nursing home residents occur frequently and repeatedly. About 1,800 older adults living in nursing homes die each year from fall-related injuries. Those who survive falls frequently sustain hip and other fractures and head injuries which often result in permanent disability and reduced quality of life. Falls in nursing homes frequently occur as a result of inadequate fall prevention measures including failure to assess residents to identify and address risk factors; failure to adequately educate and train staff about fall risk factors and prevention strategies; and failure to install and/or utilize safety devices such as grab bars, raised toilet seats, lowered bed heights, and hand rails.
Summary of a Claim Our client was an 86 year-old patient at a nursing home, who had suffered a stroke causing total incapacity on one side of his body, with no mental impairment and speech capacity intact. The nursing home records indicated the client had poor sitting balance, was prone to falling backward, and was at a high risk for falls. During the course of a physical therapy session, the therapist left the client sitting unattended on a therapy mat table while he went to get a wheelchair which he had placed on the opposite side of the room. Unable to support himself in a sitting position, our client fell backward from the table to the floor striking his head. As a result of the fall, our client sustained fractures of the first and second cervical vertebrae for which he required a fusion surgery, and was in critical care for several weeks. Our client lived only 5 months following the fall. Significantly, our client never spoke again following the surgery, including with his wife of over 60 years.
